Recognition of Non-Islamic Justice in the Works of Two Classical Islamic Political Thinkers: al-Ṭurṭūshī and Ibn Khaldūn

Abstract The present paper examines the place of non-Islamic justice in two medieval Islamic political texts, Abū Bakr al-Ṭurṭūshī’s (d. 1126) Lamp Kings ( Sirāj al-Mulūk ) and ʿAbd al-Raḥmān Ibn Khaldūn’s 1406) Prolegomena Muqaddima ). By attempting to derive principles through reason, by repudiating claims that normative values are solely derived from revelation, both thinkers commit thoroughgoing recognition forms justice. As they formulate a pessimistic account human nature, contend principal objective is deterrence innate lawlessness. And since humans deemed feeble corruptible, may settle for practical solutions, even if outside tradition scripture revelation. In final analysis, this rationalist juxtaposed aims certain strands modern traditionalism, where role reason greatly minimized, not completely subordinated For fundamentalist revivalists, categories societies intimate striking opposition between just unjust societies. While al-Ṭurṭūshī Khaldūn also maintain qualitative difference polities, their conclusions markedly different those traditionalists. notion advance, which rests on thesis, results more intent institutions laws, irrespective creedal origins.
